Your Workplace Rights: What the LGBTQI Community Agenda Means for Filipino Professionals

The workplace environment for LGBTQI+ Filipinos presents a stark reality that demands our immediate attention. According to recent data, LGBTQI+ Filipinos are twice as likely to be underemployed and three times more likely to experience workplace discrimination compared to their heterosexual counterparts. These alarming statistics aren’t just numbers, they represent countless stories of talented professionals being denied opportunities, facing harassment, and experiencing job insecurity simply because of who they are.

Understanding the Community Agenda

On May 3, 2025, LGBTQI+ advocates gathered at Liwasang Diokno at the Commission on Human Rights to present a full 6-point Community Agenda for Inclusive Governance ahead of the 2025 midterm elections. This agenda, organized under the pillars of Trabaho (Work), Edukasyon (Education), Bayan (Nation), Komunidad (Community), Kalusugan (Health), and Media, outlines critical reforms needed to ensure full inclusion and protection for LGBTQI+ Filipinos.

The first pillar, Trabaho, specifically addresses workplace discrimination, calling for equal employment opportunities through inclusive hiring policies and the expansion of Republic Act 10911 to explicitly cover SOGIESC (Sexual Orientation, Gender Identity and Expression, and Sex Characteristics). This is particularly crucial given the limited legal protections currently available to LGBTQI+ workers in the Philippines.

The Current Legal Environment

As it stands, LGBTQI+ Filipinos have severely limited legal protections against workplace discrimination. Unlike Thailand, which has national legislation protecting against discrimination based on gender expression, the Philippines only offers protection through local ordinances in a handful of jurisdictions, specifically 5 provinces, 15 cities, 1 municipality, and 3 barangays. This patchwork of protections leaves the vast majority of LGBTQI+ workers vulnerable to discrimination without legal recourse.

The consequences are evident: 21% of LGBTQI+ Filipinos believe they have been denied employment opportunities due to their SOGIESC. Also, more than 60% report seeing job advertisements that explicitly exclude LGBTQI+ individuals in their requirements.

Know Your Rights: Taking Action

Despite these challenges, there are steps LGBTQI+ professionals can take to protect themselves and advocate for change:

  1. Document everything: Keep detailed records of any discriminatory incidents, including dates, times, witnesses, and exact statements or actions.
  2. Research local protections: Check if your city or province has anti-discrimination ordinances that cover SOGIESC.
  3. Seek supportive employers: Organizations like PFIP (Philippine Financial & Inter-Industry Pride) have developed resources including the PFIP Playbook, which highlights companies with inclusive policies and best practices.
  4. Engage with advocacy: Join the “Boboto for Equality” movement pushing candidates in the 2025 elections to adopt the Community Agenda and support the long-overdue SOGIESC Bill.

The path to workplace equality requires both individual vigilance and collective action. As we approach the 2025 elections, it’s crucial that we elect leaders committed to advancing human rights for all Filipinos, regardless of sexual orientation, gender identity, or expression. The time for equality is now, and it cannot be postponed any longer.
