**Quezon City Ordinance Faces Scrutiny After Transwoman’s Restroom Incident**

In August 2019, Gretchen Diez became a prominent figure in the fight for transgender rights in the Philippines following a significant incident at Farmer’s Mall in Cubao. Unbeknownst to her, choosing to use the women’s restroom would ignite a broader discussion on transgender rights nationwide. Gretchen was denied access to the women’s facilities, resulting in her arrest and detention at the Quezon City Police District Station, a clear breach of local law that warrants our attention.

Back in 2014, Quezon City didn’t merely draft a symbolic policy; it enacted City Ordinance 2357-2014, familiarly known as the Quezon City Gender-Fair Ordinance. This legislation aims to eliminate discrimination based on sexual orientation and mandates that all government agencies, private offices, and commercial establishments provide all-gender restrooms. Thus, Farmer’s Mall was legally required to honor Gretchen’s right to use the restroom aligned with her gender identity.

Following the incident, Mayor Joy Belmonte voiced her strong disapproval of the mistreatment Gretchen faced. She reminded everyone that Quezon City had the distinction of being the first local government to implement a Gender-Fair Ordinance to safeguard LGBT+ rights. Mayor Belmonte also directed the Business Permit and Licensing Department to ensure that all businesses comply with the ordinance.

Despite the ordinance, the incident revealed the stark disparity between policy and actual practice. Many businesses and their staff either remained unaware of their legal responsibilities or, worse, chose to disregard them. This is why experts are advocating for mandatory SOGIE (Sexual Orientation and Gender Identity and Expression) training across schools and workplaces, rather than leaving such programs optional.
